An
updated Federal Register Notice (FRN
) has been posted for public inspection on the
Executive Order (EO) amendment
that added additional duties on imports that are the products of China, issued on February 5, 2025 (EO).  As explained in the EO and FRN, the administrative exemption from duty and certain taxes at 19 U.S.C. 1321(a)(2)(C) — known as the “de minimis” exemption — will be available for articles previously covered by heading 9903.01.20 that are otherwise eligible for the exemption.
The February 5, 2025, Executive Order “Amendment to Duties Addressing the Synthetic Opioid Supply Chain in the People’s Republic of China,” does not establish retroactive eligibility for de minimis treatment. Accordingly, CBP will not refund duties for any shipments denied de minimis prior to ACE’s resumption of processing de minimis clearances for shipments containing products of China and Hong Kong on February 7, 2025.
