The updated document has can be found at the following link: “ FDA Entry Filing Resource: Electronic Nicotine Delivery System (ENDS) Products ”. This is a plain language document for products offered for import into the U.S. that meet the definition of a tobacco product . To avoid delay of FDA admissibility determination, importers should provide the information needed to their customs broker. The HTS codes for these products will most likely be associated with an FD flag which is an indicator the product is regulated by FDA. These products are to be transmitted to FDA regardless of the FD flag. The contact for HTS code support has been added to this document as well. ENDS products differing in any characteristic (including brand name, flavor, etc.) must be declared on separate lines in an entry filed via ACE.
