CSMS # 63269144 - CBP Ruling HQ H318727 Used Self-Propelled Vehicles from the Continental United States to Puerto Rico U.S. Customs and Border Protection sent this bulletin at 12/04/2024 10:06 AM EST CSMS # 63269144 - CBP Ruling HQ H318727 Used Self-Propelled Vehicles from the Continental United States to Puerto Rico The “Exporting a Motor Vehicle” page on cbp.gov has been updated to provide information on used self-propelled vehicle shipments from the continental United States to Puerto Rico. This guidance supersedes guidance provided in CSMS # 49161237 dated August 24, 2021. Pursuant to CBP Ruling HQ H318727 dated July 21, 2021, it has been determined that the shipment of used self-propelled vehicles from the continental United States to Puerto Rico does not constitute an “export” as defined in 19 CFR 192.2. Puerto Rico is an unincorporated territory of the United States, and 19 CFR 101 defines the “Customs territory of the United States” as “includes only the states, District of Columbia, and Puerto Rico”. As a result, 19 CFR 192 does not apply to the shipment of used self-propelled vehicles from the United States to Puerto Rico. Although HQ H318727 does exclude the requirements of 19 CFR 192 it does not exclude the requirements of 15 CFR 30. Electronic Export Information (EEI) is still required to be filed in the Export Cargo System (AES) for all used self-propelled vehicles. The Vehicle Identification Number (VIN) or Product Identification Number (PIN) must be input on the Electronic Export Information (EEI). The Vehicle Tile State and Vehicle Title Number are not required. CBP will cease and desist enforcing the requirements of 19 CFR 192 to present vehicle ownership documentation 72 hours prior to export for used self-propelled vehicles shipped from the United States to Puerto Rico or from Puerto Rico to the United States. Used self-propelled vehicles shipped from the United States to Puerto Rico or from Puerto Rico to the United States are not exempt from being inspected.
